In the Los Angeles County Superior Court, Judge Bruce G. Iwasaki, granted defendant’s request for a stay pending an outcome in the Variety Media appeal.
Background. Casillas alleged that Anytime Fitness used website software to capture routing, addressing, or signaling information in violation of California Penal Code Section 638.51. Anytime Fitness sought a stay while an appellate court considered whether California’s trap-and-trace statute applies to website-tracking technology.
The Court’s Analysis. The court concluded that the pending appeal in Rose v. Variety Media could resolve a determinative legal issue: whether the trap-and-trace provisions cover website software. The court noted that up until Variety, California judges had to reconcile conflicting opinions on the applicability of the trap and trace law. With numerous similar cases pending, appellate guidance would promote consistency and judicial efficiency. The court therefore granted a temporary stay.
